Acceptance of these terms

These terms apply to every order placed on this website. By placing an order you accept them, together with our Privacy Policy and Refund Policy.

These terms are between you and {{LEGAL_ENTITY_NAME}}, a business registered in Kenya.

Products and availability

We sell fresh produce, including African Indigenous Vegetables, free-range Kienyeji chicken, precooked pulses and organic ghee. Because our produce is fresh and sourced seasonally, stock is limited and availability can change without notice. We may withdraw any product at any time.

Weights and counts shown on a product page are approximate for items sold by weight. If a item you receive differs materially from its description, tell us within 48 hours and we will make it right under our Refund Policy.

Pricing

Prices are quoted in Kenya shillings (KES) and exclude any delivery charges, which are calculated at checkout and shown to you before you pay. Prices may change without notice, but the price that applies to your order is the one shown when you placed it.

If a product is listed at an incorrect price and you order it in good faith, we will contact you before dispatch. You may cancel and receive a full refund, and we will not charge you the higher price.

Payment

We accept:

  • M-Pesa, via our Paystack checkout.
  • Cards, via Paystack.
  • Bank transfer or cash on delivery, where available to your area.

Your order is dispatched once payment is confirmed. If payment fails or is reversed, the order is cancelled and any reserved stock is released. We never ask for your M-Pesa PIN or full card number by phone, email or SMS.

Order acceptance

Placing an order is an offer to buy. A contract forms only when we accept your order and confirm payment. We may decline or cancel an order before that point — for example if an item is out of stock, if the price or description was wrong, or if we cannot deliver to your address — and any payment made will be refunded in full.

Please check your delivery address and phone number before paying. We cannot be held responsible for orders delivered to an address that was entered incorrectly.

Delivery

We deliver within Nairobi. Delivery days, cut-off times and charges are shown at checkout and may vary by area. Orders placed outside our delivery hours are processed the next working day.

Delivery estimates are estimates, not guarantees. Risk in the goods passes to you on delivery. Please inspect your order at the point of delivery and report any shortage or damage within 24 hours, so it can be recorded while it can still be verified.

We do not currently offer delivery outside Nairobi. Wholesale and bulk orders are handled separately — contact us to discuss.

Returns and refunds

Our Refund Policy forms part of these terms and explains how to request a return or refund, and the conditions that apply to perishable produce.

Because our goods are fresh and perishable, the right to return goods does not apply to produce that has begun to spoil as a result of late delivery or poor storage. We always honour a genuine quality complaint.

Acceptable use

You may not use this website to break the law, to interfere with its operation, to attempt to access other people’s data, or to place orders in a way that misleads us. We may refuse service to anyone who does.

Intellectual property

The Nyumbani Greens name, logo, site design, photography and written content belong to us or our licensors. You may not copy or republish them commercially without written permission. Recipes and articles on this site may be shared and used for your own cooking.

Limitation of liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Your rights under the Consumer Protection Act, 2012 are not affected.

Subject to that, and to the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profit, arising from your use of this website.

Events beyond our control

We are not liable for a failure to deliver caused by events outside our reasonable control, including severe weather, flooding, road closures, public health directives, crop failure or a disruption to our payment or courier providers. Where a delay is likely we will tell you, and you may cancel for a full refund if delivery is no longer possible.

Governing law and disputes

These terms are governed by the laws of the Republic of Kenya. If you are a consumer, you keep the protection of any mandatory provisions of the law of the country you live in.

If something goes wrong, please contact us first — most problems are resolved quickly that way. If we cannot agree, the courts of Kenya have jurisdiction. Nothing here prevents you from approaching the Office of the Data Protection Commissioner or the relevant consumer authority.

Changes to these terms

We may update these terms from time to time. The “Last updated” date at the top reflects the current version, and the terms in force are those published when you placed your order.
